Permanent Residence

There are several categories through which a client can obtain permanent residence in Canada.

 

  • We will do a comprehensive assessment/review and advise the client on selection of the right category.
  • We will prepare and submit the required paperwork and follow through with the Immigration offices.
  • We will assist the client in submitting any additional documentation as required

 

Canadian Experience Class

 

The Canadian Experience Class (CEC)  enables you to acquire a Permanent Resident status in Canada. To be considered under the  Canadian Experience Class category you :

  • cannot live in the  province of Quebec,
  • must have at least 12 months of skilled authorized work experience in Canada in the three years before you apply
  • must have the ability to speak, read write in French or English

 

Skilled work experience includes these type of jobs:

 

  • Managerial jobs (NOC skill type 0)
  • Professional jobs (NOC skill type A)
  • Technical jobs and skilled trades (NOC skill type B)

 

Express Entry

 

Citizenship and Immigration Canada (CIC) will launch a new system called “Express Entry” starting January 2015. This route to Permanent Residency is an electronic system and hopes to meet current and future labour market needs of the country. This program hopes to attract skilled workers around the world who are interested in immigrating to Canada.  Some of the improvements to Canadian immigration via Express Entry, include quicker processing times, opening up spots to more applicants from different fields, and a greater focus on screening the quality of applications.

 

Note:  Applicants currently in the system or awaiting processing will not be transferred to Express Entry. Applicants who have already applied to an existing Canadian immigration program will need to apply separately for Express Entry to be considered under this program.

 

Applicants should complete a profile and submit information about their work experience, language ability, education and other relevant details. Profiles of all applicants will be ranked and those meeting the required criteria or with qualified offers of employment will then be selected to apply for Permanent Residence. Applicants without a job offer must register with Government of Canada’s Job Bank. If applicants are selected they must submit an online application for permanent residence through one of the following programs within 60 days:

  • Federal Skilled Worker Program

  • Federal Skilled Trades Program

  • Canadian Experience Class 
  • Provincial Nominee Program

 

Citizenship and Immigration Canada states they hope to process the majority of applications within six months.

 

Family Sponsorship

 

If you are a citizen or permanent resident of Canada and at least 18 years old, you can sponsor the following relatives to Canada under the Family sponsorship class:

  • your spouse,
  • your conjugal or common-law partner,
  • your dependent child (this includes an adopted child) or
  • other eligible relatives.

Once that family member becomes a permanent resident, they can live, study and work in Canada.

 

Spousal Sponsorship

 

You can sponsor a spouse, common-law or conjugal partner, or dependent children if you are a Canadian citizen or a permanent resident of Canada. To be a sponsor, you must be 18 years of age or older. You can apply as a sponsor if your spouse, common-law or conjugal partner, or accompanying dependent children live with you in Canada, even if they do not have legal status in Canada. However, all the other requirements must be met.

 

You can also apply as a sponsor if your spouse, common-law or conjugal partner, or dependent children live outside Canada, and if they meet all the requirements.

Therefore, you have to meet certain income requirements. If you have previously sponsored relatives to come to Canada and they have later turned to the government for financial assistance, you may not be allowed to sponsor another person. Dependent Child

Adopted Child

 

Adoption (also called international adoption) is a process that recognizes an individual or couple as the legal and permanent parent(s) of a child from another country. An inter country adoption complies with the laws of both the sending and receiving countries.

 

For all inter-country adoptions, you must complete two separate processes:

1)     The adoption process; and

2)     The immigration or citizenship process.

 

In Canada, adoption comes under provincial or territorial jurisdiction. To be eligible to adopt a child, you must meet the adoption requirements of the province/territory where you live if you are living in Canada, or the country where you live if you are living abroad, the adoption authority of the country where the child lives.

 

Federal Skilled Worker

 

Who is considered a Federal Skilled Worker?

A person who can obtain at least 67 points based on your education, work experience, English and French language skills, age and adaptability. You must have at least one year of continuous and paid (full-time or an equal amount in part-time) work experience in a single occupation,within the last 10 years in one of the eligible occupations OR you must have a valid offer of arranged employment, OR must be an international student who is enrolled in a PhD program in Canada (or who graduated from a Canadian PhD program within the past 12 months).

 

What is the expected Language Proficiency for a Federal Skilled Worker?

You must prove your language levels by passing a language test from an agency approved by Citizenship and Immigration Canada (CIC). You can get a maximum of 28 points for language ability but to qualify you must get a minimum of CLB 7 for your first official language in all four language areas i.e. listen, speak read and write. To get additional points on the second official language you must get a CLB 5 in all four areas.

 

What do your mean by arranged employment?

You must have a you have a permanent job offer from a Canadian employer that has been approved by Human Resources and Skills Development Canada.

Federal Skilled Trades

 

Persons qualified in a skilled trade can apply for Permanent Residence under the Federal Skilled Trades Program.

To qualify under the Federal Skilled Trades Program you:

  • Cannot live in Quebec
  • Must be able to speak, read and write English and/or French
  • Must have completed 2 years or more of full time work experience, or an equal amount of part time work experience in a skilled trade. Must have completed these hours of work within the 5 years before application submission
  • Meet requirements set out in National Occupational Classification (NOC) in the field of skilled trade
  • Receive full time employment offer for a duration of at least one  year, or a certification of qualification in a specific skilled trade issued by the Province or Territory
  • Different provinces and territories have different processes for issuing a certificate of qualification. Each separate province and territory’s trades authority will need to assess your training, skills and experience.
